6.4 Third-Party Content.
Product information, descriptions, images, and pricing displayed on the Service may be owned by or licensed from third-party merchants and providers. All such third-party content remains the property of its respective owners. Data Formula does not claim ownership over third-party content but may have limited rights to display such content for the purposes of operating the Service.
6.5 Third-Party Trademarks.
The Service displays the names, logos, and trademarks of third-party merchants, retailers, and service providers (collectively, "Third-Party Marks"). All rights in and to the Third-Party Marks are the property of their respective owners. 7.1 Free Service.
The Service is provided free of charge to all users. Data Formula does not charge any fees for accessing or using the price comparison information displayed on css.data-formula.com.
7.2 Third-Party Transactions.
The Service may contain links to third-party merchant websites where users can complete purchases. Any transactions conducted on third-party websites are subject to the terms, conditions, and fees of those third parties. Data Formula is not a party to such transactions and bears no responsibility for pricing, payment processing, shipping, returns, or any other aspect of third-party sales.
7.3 Affiliate Relationships.
Data Formula may receive commissions or fees from third-party merchants when users click on links or make purchases through the Service. Such affiliate relationships do not affect the pricing information displayed or impose any additional costs on users.
8.1 No Guarantee of Continuous Service.
The User acknowledges and agrees that the Service may be subject to interruptions, delays, or errors due to maintenance, upgrades, technical issues, or factors outside the control of Data Formula, including failures of third-party platforms and data sources. Data Formula does not guarantee that access to or use of the Service will be uninterrupted, error-free, or secure.
8.2 Maintenance and Updates.
Data Formula may, at its sole discretion, perform scheduled or unscheduled maintenance, updates, or upgrades to the Service. While Data Formula will use reasonable efforts to minimize disruption, the User agrees that Data Formula shall not be liable for any disruption or unavailability of the Service.
8.3 Disclaimer of Warranties.
The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Data Formula expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or reliability of price information, product descriptions, or merchant data displayed through the Service.
8.4 Third-Party Services and Data.
The User acknowledges that the Service relies on third-party pricing data, product information, and merchant websites. Data Formula makes no representations or warranties regarding the availability, accuracy, completeness, or reliability of any third-party data or services, and the User agrees that any reliance on such data is at the User's sole risk. Data Formula is not responsible for changes in pricing, product availability, merchant policies, or website functionality of third parties.
8.5 Limitation of Liability for Service Disruption.
Data Formula shall not be liable for any losses, damages, or costs arising from service interruptions, errors, downtime, or inaccurate information, including but not limited to purchase decisions made based on outdated pricing, lost opportunities, or any other consequential damages.
9.1 Termination by User.
The User may cease using the Service at any time without notice. Since no account registration is required, users may simply discontinue accessing the website.
9.2 Suspension or Termination by Data Formula.
Data Formula may, at its sole discretion and without prior notice, restrict or block access to the Service for any reason, including but not limited to: (a) a breach of any provision of these Terms; (b) conduct that Data Formula reasonably believes may harm the Service or third parties; (c) abuse of the Service through automated scraping or excessive requests; or (d) operational, security, or maintenance purposes.
9.3 Survival.
The provisions of these Terms that by their nature should survive termination, including but not limited to Sections 4 (User Responsibilities), 6 (Intellectual Property), 8 (Service Availability and Disclaimer), 10 (Liability and Indemnification), and 12–14 (Governing Law, Miscellaneous), shall survive any termination of these Terms.
10.1 Limitation of Liability.
To the maximum extent permitted by applicable law, Data Formula, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, loss of business, financial losses from purchasing decisions, or any other damages arising out of or in connection with the User's access to or use of the Service, even if Data Formula has been advised of the possibility of such damages.
10.2 Aggregate Liability.
The total aggregate liability of Data Formula, whether in contract, tort, or otherwise, arising out of or relating to these Terms or the User's use of the Service shall not exceed one hundred euros (€100).
10.3 No Warranty for Third-Party Data.
The User acknowledges that the Service relies entirely on third-party pricing data and merchant information. Data Formula shall have no liability for errors, omissions, inaccuracies, or interruptions in such third-party data or services. Users must verify all information directly with merchants before making purchase decisions.
10.4 Indemnification by User.
The User agrees to defend, indemnify, and hold harmless Data Formula, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) the User's breach of these Terms; (b) the User's violation of applicable laws or regulations; (c) the User's infringement of any intellectual property, proprietary, or privacy rights of any third party; or (d) the User's use of the Service in a manner not expressly authorized by these Terms.
10.5 Informational Purpose Only.
The User acknowledges that the Service is intended for informational purposes only and that all purchasing decisions are made at the User's sole discretion and risk. Data Formula does not guarantee any cost savings, product quality, merchant reliability, or other outcomes arising from use of the Service.
11.1 Applicable Laws.
The User agrees to comply with all applicable laws and regulations in connection with its use of the Service, including, without limitation, laws governing consumer protection, privacy, and intellectual property.
11.2 Third-Party Merchant Policies.
The User acknowledges that purchases made through links on the Service are subject to the terms, policies, return policies, and guidelines of the respective third-party merchants. Data Formula shall not be responsible for any issues, disputes, or problems arising from transactions with third-party merchants.
11.3 Export Control and Sanctions.
The User shall not use the Service in violation of any applicable export control or economic sanctions laws, including those of the European Union, United States, or any other relevant jurisdiction.
11.4 Legal Requests.
Data Formula may disclose information to comply with legal obligations, government requests, court orders, or law enforcement inquiries, to the extent permitted or required by applicable law.
11.5 No Unlawful Use.
The User shall not use the Service to engage in any illegal, fraudulent, or harmful activity, including, but not limited to, transmitting malware, spamming, infringing the rights of third parties, or manipulating pricing information.
12.1 Right to Amend.
Data Formula reserves the right, at its sole discretion, to modify, update, or revise these Terms at any time.
12.2 Notice of Changes.
Data Formula may provide notice of material changes to the Terms by posting an updated version on the Service with a revised "Last updated" date. It is the User's responsibility to review the Terms periodically to remain informed of any changes.
12.3 Continued Use.
By continuing to access or use the Service after any amendments to the Terms, the User agrees to be bound by the revised Terms. If the User does not agree to the revised Terms, the User must immediately cease use of the Service.
13.1 Governing Law.
These Terms, and any disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of France, without regard to its conflict of laws principles.
13.2 Jurisdiction.
Any dispute, claim, or controversy arising out of or in connection with these Terms, including the validity, breach, or termination thereof, shall be submitted to the exclusive jurisdiction of the competent courts of Lyon, France, unless otherwise required by mandatory law.
14.1 Severability.
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect.
14.2 Entire Agreement.
These Terms, together with any applicable Privacy Policy and any other documents expressly incorporated herein, constitute the entire agreement between the User and Data Formula regarding the use of the Service and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral.
14.3 Waiver.
No failure or delay by Data Formula in exercising any right or remedy under these Terms shall constitute a waiver of such right or remedy, nor shall any single or partial exercise preclude any other or further exercise of such right or remedy.
14.4 Assignment.
The User may not assign or transfer these Terms or any rights or obligations hereunder without the prior written consent of Data Formula. Data Formula may assign or transfer these Terms without restriction.
14.5 Force Majeure.
Data Formula shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, network failures, strikes, or pandemics.
